These Terms of Service ("Terms") govern your access to and use of PulseWatch (the "Service"). By using the Service you agree to these Terms.
1. Eligibility and accounts
You must be at least 16 years old to use the Service. You're responsible for your account credentials and for activity under your account.
2. Acceptable use
- Don't submit false outage reports or interfere with our detection systems.
- Don't scrape, reverse engineer, or abuse the API beyond the limits of your plan.
- Don't use the Service to violate laws or infringe others' rights.
- Don't attempt to disrupt, overload, or compromise platform security.

3. Plans, billing, and changes
Paid plans are billed in advance on a monthly or yearly basis. You can upgrade, downgrade, or cancel at any time from Billing. Downgrades take effect at the end of the current period. Fees are non-refundable except where required by law.
4. Service availability
We aim for high availability but the Service is provided "as is" without uptime commitments outside of contractual SLAs for Enterprise customers. Scheduled maintenance will be communicated in advance where practical.
5. Intellectual property
PulseWatch owns the Service, branding, and platform content. You retain ownership of your data and grant us a limited license to process it to operate the Service.
6. Third-party services
The Service integrates with third parties (e.g., Slack, Stripe, webhook endpoints you configure). Your use of those services is governed by their own terms.
7. Confidentiality and data
We treat customer data as confidential. How we process personal data is described in the Privacy Policy.
8. Disclaimers
Informational only. The Service is provided "as is" and "as available," for informational purposes. Outage detection is probabilistic and synthesized from community reports, public status pages, and automated signals — none of which PulseWatch controls or independently verifies in real time. Detected incidents, severity scores, confidence ratings, leaderboards, postmortems, and any AI-generated analyses (including the AI Incident Analyst) are best-effort hypotheses, not confirmed facts, root causes, or statements from the underlying vendor.
No warranties. To the maximum extent permitted by law, PulseWatch disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, non-infringement, and that the Service will be uninterrupted or error-free.
No reliance for critical decisions. The Service is a monitoring and intelligence aid — it is not a substitute for the official status pages, support channels, or contractual SLAs of the services we monitor. You should not rely on PulseWatch alone for safety-critical, financial, medical, or legally consequential decisions.
Independence and trademarks. PulseWatch is independent and is not affiliated with, endorsed by, sponsored by, or otherwise connected to any of the services it monitors. All third-party names, logos, and trademarks belong to their respective owners and are used for identification purposes only.
9. Limitation of liability
To the maximum extent permitted by law, PulseWatch and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to your use of (or inability to use) the Service — including any decisions made or actions taken based on detected incidents, AI-generated hypotheses, or any other Service output. This applies whether the claim is based in contract, tort, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
Subject to the foregoing, PulseWatch's aggregate liability for any and all claims arising out of or relating to these Terms or the Service is limited to the greater of (a) the fees you paid to PulseWatch in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
Indemnification. You agree to defend, indemnify, and hold PulseWatch harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising out of (i) your use of the Service in violation of these Terms or applicable law, or (ii) decisions you or your organization make in reliance on the Service.
10. Termination
You can cancel at any time. We may suspend or terminate accounts that violate these Terms or present a security risk.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which PulseWatch is incorporated, without regard to conflict-of-law rules.
